WITHOUT a legal Will that specifies your Executor, individuals can apply to the Courts for Letters of Administration. There is an order of who can apply, usually family members first. Whoever is assigned by the Courts will administer the estate, as per the directions and decisions of the court as to who will inherit from your estate. Without a Will it doesn’t necessarily go to who you think will receive it.
WITH A LEGAL WILL, wherein you name the Executor, YOU are choosing the person you trust to manage your estate and make the decisions, and YOU identify who gets all your possessions.
